Privacy Policy

This Privacy Policy describes the policies and procedures of The Rittmann Group, LLC ("Company", "We", "Us", or "Our") on the collection, use and disclosure of Your information when You use our Service (the "Service"). It also explains your privacy rights and how various laws protects You.

By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy. We are committed to student and teacher data privacy and comply with applicable laws, including the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), and the Colorado Privacy Act (CPA). Our Service provides secular educational curriculum materials aligned with Texas Essential Knowledge and Skills (TEKS) standards for educators. All resources are offered under a single-user license and may include both editable and non-editable materials. We do not collect sensitive personal data (such as religious or demographic information).

Words in which the initial letter is capitalized have specific meanings defined below. These definitions shall apply regardless of whether they appear in singular or plural form.

  • Account means a unique account created for You to access our Service or parts of our Service.

  • You (or "User" or "Your") means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Account Credentials
  • Transactional Information
  • Communications

We do not collect any more personal data than is necessary to provide our Services. We do not seek or collect sensitive personal information such as government-issued identifiers,  biometric data, or financial account numbers (credit card details are handled by third-party payment processors and not stored by Us). We also do not collect any information about your students or classroom unless you voluntarily provide it. In line with our secular curriculum and nondiscrimination policy, we do not request or collect data about you or your students' race, ethnicity, religious beliefs, or other demographic information.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and Your experience.

We do not use personal data for any purposes that are incompatible with those listed above. In particular, we do not sell your personal data to third parties. Any use of student information (if provided by an educator using the Service) is strictly limited to educational purposes as described in the Student Privacy section below.

 

We value your privacy and may only share Your personal information or data in limited circumstances, as described below:

  • With Service Providers: We may share Your personal information with third-party service providers  who perform services on Our behalf, to monitor and analyze the use of our Service, or to contact You. This may include payment processors, email service providers, analytics providers, or hosting providers. Such service providers are contractually obligated to keep personal information and data confidential and use it only for the purposes of providing services to Us.
  • For Business Transfers or Partners: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company. Any such parties will be required to honor the privacy commitments We make here.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions. Any such parties will be required to honor the privacy commitments We make here.
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent. 

We do not share your personal information with third parties for their own marketing or advertising purposes. 

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes for which it was collected, as set out in this Privacy Policy, or required by law.

We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

You should also take steps to protect Your personal information by keeping Your account credentials secure and logging out of the Website after Your session.   • Correction: You have the right to request correction of any inaccurate or incomplete personal data we hold about You.
  • Deletion: You have the right to request that We delete your personal data, subject to certain exceptions (for example, We may retain data if required by law or if it is needed for ongoing legitimate business interests such as fraud prevention or to provide You with the Services of Our Website).
  • Non-Discrimination: We will not discriminate against You for exercising any of Your privacy rights. Exercising Your rights will not result in denial of our Service, loss of any benefits, or higher charges.

We may need to verify your identity before fulfilling certain requests (for example, by asking you to log into your account or provide additional information). We will respond to your request within the timeframe required by law (generally within 45 days for CPA requests, with an extension if reasonably necessary, of which we will notify you). If we cannot fulfill your request, we will provide an explanation.

Please note that if you are an educator or school official who has provided us with student personal data, the relevant educational institution may need to be involved in fulfilling requests to access or delete student information, in compliance with FERPA or other applicable laws. We will cooperate with and defer to educational institutions regarding requests relating to student records.

Children's Privacy

Our Service does not address anyone under the age of 13. In accordance with the U.S. Children's Online Privacy Protection Act (COPPA), if You are under 13 years of age, You are not permitted to use this Service or provide any personal information to us. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with personal data, please contact Us immediately. If We become aware that We have inadvertently collected personal data from anyone under the age of 13 without proper consent or verification of parental consent, We take prompt steps to remove that information from Our servers. We will also comply with any parental requests to review or delete a child's information, as required by COPPA.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent or guardian for minors, We will require the appropriate consent before We collect or use that information.

Note for Teenagers

If You are at least 13 years old but under 18 years old, You should only use the Service with the involvement and consent of a parent or legal guardian. We encourage parents to supervise their children’s internet usage and to help enforce this Privacy Policy by instructing their children never to provide personal information on this Service without permission.

Student Privacy (FERPA)

We understand that educators (teachers, homeschoolers, school administrators, or school districts) may use Our Services in a classroom setting. Protecting student privacy is of paramount importance to Us. However, our Service is designed to provide curriculum resources only. We do not provide functionality for uploading, storing, or transmitting student information. The following additional terms apply in order to comply with the Family Educational Rights and Privacy Act (FERPA) and other student privacy laws:

  • FERPA Awareness: While we do not act as a “school official” under FERPA because no student records flow through our Service, we are mindful that schools and educators must meet their obligations under FERPA. Our policies and product design intentionally minimize data collection to support that compliance.
  • No Student Records Collected: We do not request, accept, or store personally identifiable student information or educational records of any kind.

  • Educator Responsibility: Educators are solely responsible for ensuring that their classroom use of our materials complies with FERPA and any other applicable student privacy laws. Since our Service does not collect or store student data, there are no FERPA-covered “student records” managed by Lesson Plan Guru.

  • Curriculum Only: Our resources are secular, TEKS-aligned instructional materials intended to be used by teachers in their classrooms. They are provided “as is” for educational purposes and do not include any tools for student data entry or management.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes to this Privacy Policy

We may update or revise this Privacy Policy from time to time. If We make material changes, You will be notified by Us via email (if we have your email address on file) of such changes. We will also update the "Last Updated" date at the top of this Privacy Policy to indicate the date of the latest revision.
